Terms and Conditions

1 All surveys, estimates and quotations that are carried out at site are valid for 60 days unless otherwise stated. After 60 days from date detailed on the estimate, they may be subject to us carrying out a further site visit or recalculation. Where a survey is required this will need to be paid for in advance, if a copy of a survey is required then a 20% charge will be made. NOTE a survey is only issued to the person who has requested the survey and NOT the vendor of a property. All clients must sign and return the terms and conditions thus agreeing to works outlined and or payment terms before any work commences.

2 All prices are based on what is in the detailed estimate. If you the client require any variations in works not detailed in estimate then this will be discussed and a further charge will be agreed. M J S Developments will endeavour to send in writing an amended estimate with the added alterations or amendments in work before work commences if not before completion. However there may be occasions where this does not happen and when this arises it is down to you the client to ensure that the paperwork and the agreement of variations are in place otherwise these will be liable to the extra charges in question. If there are any further changes in you the client’s requirements other than those that have been detailed in an estimate or amended estimate this will be the subject of an extra charge. Please note this does include any changes in the re sighting of pipework i.e. plumbing, electrical wiring and sockets, switches, sanitary ware WC and basin etc. carpentry tiling and painting and decorating.

3 All clients will be required to settle invoices in full within 14 days 10 working days from the date stated unless a written authorisation has been given. All invoices will either be emailed or if clients do not have access to Internet we will send invoice via royal mail. If any of our clients have any questions regarding any part of your invoice please let us know as soon as possible so we can resolve the issue. Any client not authorised to have more than 10 working days in the first instance will receive an unpaid invoice reminder giving them a further 7 days to settle in full after this period M J S Developments will execute their statuary right to charge interest on the total amount and compensation if the case arises where we have to use a debt recovery services under the 2002 late payment legislation. All materials supplied by M J S Developments will remain the property of the company until invoices are settled in full and may be removed at any time.

3a All clients that require special order items i.e. windows, doors, kitchen and bathroom items etc, will be expected to pay a minimum of a 50% deposit at the time of order and then the balance when works commence. For items that are non-returnable i.e. specially made windows and doors, steel joists, carpentry joinery items etc then these will be expected to be paid for in full at time of order.

4 Labour is warranted for 1 year from the date of completion of the works. All of our materials used will have different levels of warranty i.e. showers, electrical, boilers, cylinders etc. you will be notified of these at the time and we will always help if required to fill in paperwork and activate guarantees. M J S Developments labour warrantee is ONLY valid on materials supplied by M J S.

5 Electrical works will be certified either by registered NAPPIT or NICEIC electrician on request. Registered gas safe engineer will certify gas works. M J S will make an additional charge for this service. M J S Developments has operatives that are gas safe, NICEIC, HEATAS trained.

6 Whilst we will take the upmost care of your property and possessions M J S Developments will not accept any responsibility for any existing hot and cold-water plumbing or heating systems should any work be undertaken on them.

7 Whilst we will take the upmost care to protect your home and possessions no responsibility will be taken for furniture or furnishings, fixtures and fittings or redecoration unless you the Client and M J S have arranged for this. There may be a charge made for the clearing of a space or emptying of a room to allow us to work in it safely.

8 Any works resulting in M J S having to make good any internal floors, walls, ceilings, external paths, patios walls, etc. unless specified in estimate will be the subject of an extra charge.

9 M J S is perfectly ok with you the client supplying materials if you wish to do so but if materials, fixtures etc. are found to be faulty or have suffered damage when we are due to fit them, then you the client will be charged accordingly for time spent where staff are unable to work. If materials or a product that has been supplied by you the client and this is found to be of poor quality or means it takes longer to fit then an extra charge may be incurred.

9a M J S is perfectly OK with you the client supplying materials if you wish to do so but if these are found to be faulty after they have been fitted or they do not last the term of the warranty you have been supplied then M J S will not be held responsible, we will endeavour to sort the problem but you the client will be charged accordingly.

9c If circumstances arise and a part or a seal/component is found to be faulty then we will endeavour to come back as soon as we can or we will arrange for a third party to do this on our behalf. If a third party is used which has not been instructed to do so then all guarantees will be made invalid.

10 At M J S we pride ourselves on being very tidy and we will complete all works as neatly as possible. We cannot guarantee any pipes or electrical cabling that is concealed in walls or floors unless specified by the client and chasing in costs may be incurred.

11 Where plumbing and heating estimates are quoted these include M J S Developments choice of materials unless we have a prior arrangement. (E.g. waste pipe and fittings will be either in black or white, soil stack pipes will be black, under ground pipes in brown, guttering in half round black, grey poly plumb and British standard copper. Where electrical work is to be carried out unless otherwise stated in your estimate this will be surface mounted in the appropriate sized white trunking.

12 Where we carry out painting and decorating our costs for this will be reduced from our normal labour rate and you the client will be notified of this in your estimate. The costs will include two coats of emulsion on walls and ceilings, primer and or undercoat, gloss on woodwork, skirting, doors, banisters, etc.

13 Where M J S is carrying out tiling work there may be an extra change applied if we use fine mosaics or if natural stone as these take longer to install and need sealing, impregnating. If you the client supply tiles we don’t except responsibility for tiles supplied damaged or miss calculation.

14 Where M J S have carried out any works we will remove any waste either back to our unit or supply a skip at your property these will be on your estimate. If you are not sure whether this is the case please contact the office. If you the client arrange for the removal of your waste a registered company can only carry it out. M J S has this certification and has a waste carriers licence but this does come at a cost and we may put a small addition of this on your invoice.

15 Whilst M J S staff are highly experienced and we all take the utmost due care and attention to avoid any damage to any existing services we cannot be held responsible for damage. If it is known by you the client where any of the services are within your boundary then please inform us in advance especially if there are any in our areas of works.

16 At M J S we aim to start all works on the agreed dates, but there are some occasions where this is not possible where works over run for numerous reasons. We will aim to notify you in plenty of time and would appreciate if you the client would also do this for us.

17 If for any reason you feel you should need to make a complaint please in the first instance call M J Samuell on the above numbers or email below otherwise in writing to the above address and I will make every effort to resolve the matter to your satisfaction.

18 Where you the client and us M J S have agreed an estimate and a start date and you the client wishes to cancel the works for any reason within 28 days of the agreed start date then you the client will be liable to a 15% charge of the estimate, 28 to 42 days will be 10% and 43 to 60 days will be 5%
